| Title: | The Legal Void of Liberty Restriction: Involuntary Treatment of Bacilliferous Patients with Mycobacterium Tuberculosis |

| Abstract: | INTRODUCTION AND OBJECTIVES Tuberculosis (TB) was declared a global emergency by WHO and, despite significant progress in reducing TB's incidence, there has been an increase in resistant forms and a decay in the decrease of new cases. This epidemiological threat is even more relevant if individuals refuse treatment, as they put in conflict several constitutionally protected rights. This study aims to evaluate the importance of addressing this legal void and whether the involuntary treatment is appropriate and proportionate to the current TB's epidemiological situation, justifying the regularization of this measure for public health protection. MATERIAL AND METHODS A review on TB literature was conducted across different official entities to characterize TB's mechanisms of infection, transmissibility, diagnosis, therapy and resistance. Concerning the study of the legal void and framework, a review on diverse Portuguese and European databases was carried out. Lastly, a search on Pubmed was performed. RESULTS TB's literature review showed its easy transmissibility, making it highly contagious in social environments. Like susceptible TB, resistant TB rates vary significantly between countries, making it a global concern and a public health threat. Two Portuguese Court Rulings, several articles, European and National laws ruled in favor of involuntary treatment, considering it can be justifiable in certain situations. CONCLUSIONS Deprivation of liberty is the most severe measure a State can impose in the name of public health. Due to TB's highly contagious nature, refusal of treatment may require restrictive measures, such as the involuntary treatment. In Portugal there is no Constitutional basis for its application within Public Health scope. Therefore, resolving this legal void is of special importance as this legislation will facilitate the conflict resolution between individuals' and community's rights, minimizing the negative impact of TB transmission on people's lives, health and society and would guarantee a standardized, equal and non-discriminatory intervention. |
| Description: | NTRODUÇÃO E OBJETIVOS A Tuberculose (TB) foi declarada uma emergência global pela OMS e, apesar de progressos significativos na redução da incidência de TB, têm se registado um aumento das formas resistentes, bem como um decréscimo na redução de novos casos. Esta ameaça epidemiológica torna-se ainda mais relevante se os indivíduos recusarem tratamento, uma vez que colocam em conflito diversos direitos constitucionalmente protegidos. Este estudo tem como objetivo avaliar a importância de abordar este vazio legal e se o tratamento involuntário é apropriado e proporcional à situação epidemiológica da TB, justificando a regularização desta medida no âmbito da proteção da saúde pública. MATERIAIS E MÉTODOS Uma revisão da literatura referente à TB foi realizada em diversas plataformas oficiais, de forma a caracterizar os mecanismos de infeção, transmissibilidade, diagnóstico, terapêutica e resistência da TB. No que diz respeito ao estudo do vazio legal e da estrutura legal, uma revisão em várias databases Portuguesas e Europeias foi realizada. Por último, foi conduzida uma pesquisa na PubMed. RESULTADOS A revisão da literatura referente à TB demonstrou a sua fácil transmissibilidade, tornando-a altamente contagiosa em ambientes sociais. Tal como na TB suscetível, as taxas de TB resistente variam significativamente entre países, pelo que é uma preocupação global e uma ameaça à saúde pública. Dois Acórdãos Portugueses, diversos artigos e leis Nacionais e Europeias declararam-se a favor do tratamento involuntário, considerando-o justificável em certas situações. CONCLUSÃO A restrição de liberdade é a medida mais severa que o Estado pode impor em nome da saúde pública. Pela elevada contagiosidade da TB, a recusa de tratamento pode requerer medidas restritivas, como é o caso do tratamento involuntário. No entanto, em Portugal não existe nenhuma base Constitucional para a sua aplicação no âmbito da saúde pública. Assim, a resolução deste vazio jurídico é de especial importância, já que a sua legislação viria facilitar a resolução do conflito entre direitos individuais e da comunidade, minimizando o impacto negativo que a transmissão da TB traz na vida e saúde dos indivíduos e da comunidade e iria garantir uma intervenção estandardizada, equitativa e não discriminatória |
