|Promotion of Local Governments' Financial Sustainability Through a Reform in Municipal Development Charges
|This communication presents a proposal to reformulate the Portuguese M unicipal Development Charges in order to standardize its computation and generalize its application to the w hole national territory ! in order to assure that investment costs carried out w ith infrastructure execution, maintenance, and reinforcement required by development changes in the extension or intensity of land uses are recovered, providing for the municipal economic and financial sustainability, and for a transparent and equitable distribution of costs and benefits that accrue from planning decisions. This reflection links up w ith the revision of the juridical regime of territorial management tools, namely the juridical regime of urban development and building, municipal master plans and respective regulations, and other legislation that falls on territory, such as the municipal real!estate tax. Thus the reform of municipal development charges are pressing w ithin the current framew ork of crisis that strongly shapes municipal finances, and expresses the concern to provide municipalities w ith sustainable tools in order to fight for the rights of their citizens. The theoretical proposal currently presented is applied, as a case study, to the municipality of Bragança. It starts w ith the analysis of the situation resulting from the application of the currently enforced municipal development charges, then the goals and characteristics of the alternative development charges are exposed, the resulting values are computed and, finally, comparisons are carried out betw een the former and the latter. The section of conclusions and recommendations stresses the importance of this reassessment of municipal development charges in order to evaluate the municipal costs and benefits that accrue from the application of this proposed formula in comparison to the current situation; to clarify the origins and applications of funds aimed at development activities; to quantify in a transparent w ay, and based on a fair and objective parameterization the values charged to developers/promoters/builders, according to the benefits they extract from public services and land surplus!values resulting from planning decisions; and assure an increased fairness in the distribution of development costs and benefits among the population w ithin a certain municipality, and among different municipalities.
