A circulação intracomunitária de bens culturais no direito da união europeia: um quadro coerente de orientações jurídicas? = The intra-community movement of cultural goods in european union law: a legal framework of coherent guidelines?

Abstract

The principle of freedom of movement is one of the pillars of the European Union, thus being of almost absolute nature, only tolerating very restricted, and particularly relevant, exceptions. One of the subjects comprised in these possible exceptions, is the protection of cultural diversities of the Member States, under which are allowed some restrictions on the movement of cultural goods; but, in the opposite direction, there are cases in which Union Law disregards the imperatives arising from national cultural diversities. Considering those legal guidelines, which coexist and point in opposite directions, it's important to assess, taking into account the backdrop of the current legal-political landscape of the European Union, the consistency of such legal guidelines.
