Abstract: Enhanced cooperation, which emerged at a late stage of the European integration process, is an important mechanism that, due to its philosophy and its outline, has raised controversy and difficult problems of theoretical construction. On the other hand, and despite its undeniable importance, the issue of fundamental rights hasn't also followed a linear path in the context of European integration, orbiting around three main strands (legal texts, policy statements and case law) and raising, likewise, several questions. The introduction of enhanced cooperations leads to the question of their eventual intersection with fundamental rights. And if one concludes, as we do, in the sense of the possibility of collisions between both realities, it must then be determined the legal framework for dealing with such conflicts.
