| Abstract: | In 19th century legal studies (e.g. Frauenstädt, 1881), blood revenge is referred to as the original form of legal practice and considered to be the first step of man towards the full rule of law during the early stages of social development. In medieval literature, blood revenge represents an important theme and through an analysis of Wolfram von Eschenbach's Willehalm (one of the most important works of medieval German literature) the often very problematic relationship between revenge and justice is discussed. |
| Description: | Em estudos de jurisprudência do séc. XIX (por ex. Frauenstädt, 1881), a vingança de sangue é referida como a forma original da prática jurídica, tratando-se, nos estados primordiais do desenvolvimento social, do primeiro passo do homem no caminho para o pleno estado de direito. Na literatura do período medieval, a vingança de sangue representa um tema importante e através de uma análise da obra 'Willehalm' de Wolfram von Eschenbach (uma das obras mais importantes da literatura alemã do séc. XIII) discute-se a relação por vezes muito problemática entre a vingança e a justiça. |
